1Acceptance of Terms
Welcome to PureFumez! These Terms and Conditions ("Terms") govern your access to and use of the PureFumez website and services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
Important: You must be at least 13 years old to use PureFumez. By using the Service, you represent that you meet this age requirement.
2Description of Service
PureFumez is a web application designed for perfumers and fragrance enthusiasts. The Service allows you to:
- Create and manage a personal library of fragrance materials
- Design, organize, and version perfume formulas
- Calculate concentrations, IFRA compliance, and formula weights
- Categorize materials using custom and system profiles
- Optionally share formulas and materials with others
- Export your data in various formats
We may modify, suspend, or discontinue any aspect of the Service at any time, including the availability of features, databases, or content. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
3User Accounts
To use most features of PureFumez, you must create an account. When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update any information that changes
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
You may not share your account with others or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4Your Content & Ownership
You Own Your Creations
All formulas, materials, profiles, and other content you create on PureFumez belong entirely to you. We do not claim any ownership or intellectual property rights over your creations.
Your Rights
- You retain full ownership of all content you create
- You can export your data at any time
- You can delete your content and account at any time
- Your unpublished content is private and accessible only to you
License to PureFumez
By using the Service, you grant PureFumez a limited license to store, display (to you), and process your content solely for the purpose of providing the Service. This license:
- Is limited to what's necessary to operate the Service
- Does not grant us rights to sell or commercially use your content
- Does not allow us to view your private content
- Terminates when you delete your content or account
Published Content
If you choose to publish or share content, you grant others the ability to view that content. You remain responsible for any content you choose to make public. You can unpublish content at any time to make it private again.
5Acceptable Use
You agree to use PureFumez only for lawful purposes and in accordance with these Terms. You agree NOT to:
Use the Service for any illegal purpose or in violation of any laws
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Upload malicious code, viruses, or harmful content
Scrape, harvest, or collect data from the Service without permission
Impersonate others or misrepresent your affiliation
6Intellectual Property
The PureFumez Service, including its original content (excluding user content), features, functionality, design, and branding, is and will remain the exclusive property of PureFumez and its licensors.
The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.
Nothing in these Terms grants you any right to use the PureFumez name, logo, or other branding for any purpose without our express written consent.
7PRO Subscription & Payments
PureFumez offers a free tier with basic features and a PRO subscription with additional capabilities.
Billing
- PRO subscriptions are billed on a recurring basis (monthly or annually)
- All payments are processed securely through Stripe
- Prices are displayed in your local currency where available
- You authorize us to charge your payment method on each billing cycle
Cancellation & Refunds
- You may cancel your subscription at any time
- Cancellation takes effect at the end of your current billing period
- You retain access to PRO features until your subscription expires
- Refunds are handled on a case-by-case basis — contact us if you have concerns
Price Changes
We may change subscription prices from time to time. Any price changes will be communicated in advance and will apply to your next billing cycle after the change. Continued use after a price change constitutes acceptance of the new price.
8Disclaimers
Important Safety Notice
PureFumez is a tool to help organize and calculate perfume formulas. It is NOT a substitute for professional safety guidance. You are solely responsible for:
- Verifying IFRA guidelines and safety regulations independently
- Ensuring your formulas are safe for their intended use
- Testing all formulas appropriately before use or sale
- Complying with all applicable laws and regulations
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free
- Results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your specific requirements
9Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUREFUMEZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Service interruption or computer damage
- Cost of substitute services
- Any damages arising from your use of the Service
Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $100 USD, whichever is greater.
10Termination
You may terminate your account at any time by deleting it through the Service or by contacting us. We may terminate or suspend your access immediately, without prior notice, if:
- You breach any provision of these Terms
- Your conduct may harm other users or the Service
- We are required to do so by law
- We discontinue the Service
Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
11Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we may also notify you via email or through the Service.
Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you should stop using the Service.
12Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes may be submitted to binding arbitration or the courts of competent jurisdiction.
